Copyrights and Data protection

In this article we will talk about copyright and the protection of personal data from the legislation both at European level and in each of the countries involved in the project REVETAX

 

THE RIGHTS OF THE AUTHOR

copyrightIt is important to understand that the Member States shall provide the exclusive right to authorize or prohibit the direct or indirect, temporary or permanent reproduction by any means and in any form, of the whole or part of a work created by an author.


Any work or article will at some point be protected by the rights of the author, although in such an appeal does not mention the word copyright, including those that are published on the Internet; since the author is the owner of the copyright in the inception of the Web resource (article, animation, sound...), and enrolment in any type of registration is not necessary to make use of this right.


It is therefore appropriate to say that resources that exist on the internet have the same legislation as that applies in other areas and other formats.


The law on copyright in Europe, is given by Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 and particularly in article 5(3) are exceptions and limitations for the use of copyright in the field of education.

WIPO

The WIPO organization is the World Forum in relation to services, policies, cooperation and information in the field of intellectual property (IP). Is a body of the United Nations, self-financing, which has 188 States members and where can resolve doubts about the intellectual property http://www.wipo.int

With regard to the legislation in each of the countries that comprise the Revetax project, are legislated by a set of laws, rules and regulations to which we link to WIPO page by itself outside of the reader's interest

 DATA PROTECTION

privacy-policyPersonal data protection is a fundamental right in the European framework. It is regulated by the Directive 95/46/EC European directive http://eur-lex.europa.eu/legal-content/EN/TXT/HTML/?uri=CELEX:31995L0046&from=is, and it is  the most competent to regulate such rights legislation in each country

Within the REVETAX project, the situation differs greatly between countries. Spanish and English laws are the most advanced in this area

The European directive aims to protect the rights and freedoms of persons as regards the processing of personal data. You are able to collect personal data if the person concerned has unambiguously given his consent, if treatment is necessary for the fulfillment of a contract to which the person concerned is a party, or for the fulfillment of a legal obligation of the controller so as to protect the vital interests of the person whose data are try.

They will be treated fairly and lawfully, and collected for specific, explicit and legitimate purposes having the right information, the right to access the data of the person concerned, as well as oppose to the processing of data

In the case of Spain the fundamental points to be applied to both public and private company must register before the Agency of protection of data www.aepd.es the structure of the files containing the information, as well as measures that are applied to protect such, through the forms provided by the Agency.

Be must inform patients of their rights when collected data, measures taken by the company of nature technical and organizational necessary to guarantee the security of the personal data and avoid their alteration, loss, treatment or unauthorized access as well as duty of professional secrecy, prohibition of transfer and transfer of data to third parties.

encryptedIn the United Kingdom the basic obligations that face companies are the register the organization that you want to collect data from the competent body, in this case ICO, duty to inform those affected by organizations both public and private, rights that have affected such, duty to take measures to protect the data that remain and the prohibition of transfer of data to third countries that do not provide the appropriate level of protection.

Hungary in the year 2012 I think Office NAIH http://www.naih.hu for the protection of personal data, where citizens can exercise their right, under the Constitution, Hungarian as well as law NAIH, as well as ratified the Council of Europe Convention for the protection of persons include all the essential principles necessary to verify the existence of an adequate level of protection of the protection of natural persons for the purposes of paragraph 2 of article 25 of Directive 95/46/EC, by what is regarded as Hungary to guarantee an adequate level of protection for personal data transferred from the European Union.
